Kalos Services Inc. (referred to as “Kalos,” “we,” or “us”), a Florida licensed HVAC contractor (License No.CAC1814620) is pleased to offer a special residential HVAC service and repair promotion (“Promotions”) to our customers. These Terms & Conditions govern the use of our Resi2025, Complete2025, and Comfort2025 promotions. By participating in these promotions or redeeming any promotional offer, you (“Customer” or “you”) acknowledge and agree to the following terms, which comply with applicable Florida state laws, contractor advertising rules, consumer protection requirements, and federal advertising standards.
1. Eligibility and Service Area
- Service Area: Our promotions are available only to customers in our Central Florida service area, which includes Lake, Orange, Osceola, Polk, Seminole, and Sumter counties. This covers numerous Central Florida communities (e.g. Clermont, Orlando, Kissimmee, The Villages, Davenport, Mt. Dora, Windermere, and surrounding areas). Customers must reside in or the service location must be within these areas to qualify.
- Eligible Customers: Promotions are valid for residential customers (homeowners or authorized renters) seeking to enroll in a new maintenance agreement valid on HVAC maintenance or repair services for their home. Commercial or new construction projects are not eligible unless expressly stated. You must be 18 years or older and legally able to enter a service agreement. Kalos employees, affiliates, and their immediate families are typically not eligible for these customer promotions.
- One Per Household: Each promotion is limited to one per household. A single household/address may redeem each distinct promo code only once during the promotion period (multiple different promotions can be redeemed if eligible, but no promotion can be used more than once per address).
2. Description of Promotional Offers
We are offering the following special discounts or value-added services for a limited time in 2025 (each a “Promotion”). All promotions are subject to availability of parts and scheduling. To redeem, you must mention the corresponding promo code when scheduling service or use the code at time of booking online or via phone so that it is applied to your account. Offers expire on August 31, 2025, unless extended or terminated early by Kalos in writing. The promotions and their key terms are:
- Resi2025 – Save $100 off residential HVAC service or repairs when enrolling in a new maintenance plan: This promotion provides a one time savings of $100 off the normal service charge for a residential HVAC service or repair. The actual discount equals the service or repair charge, capped at $100. For example, if the residential HVAC repair normally costs $100 or less, it will be free with this promo (cost covered up to $100). If the service costs more (e.g. $200), the maximum $100 discount is applied and you pay only the remaining $100 balance. This offer is valid for only one service or repair (one unit per household) and requires that the unit be accessible and in a serviceable condition (e.g. not irreparably damaged). The Resi2025 code must be mentioned prior to or at time of service scheduling to receive the discount. Standard diagnostic fees (see Section 4) may apply if no service is ultimately performed.
- Complete2025 – Save $100 off residential HVAC service or repairs when enrolling in a new maintenance plan: This promotion provides a one time savings of $100 off the normal service charge for a residential HVAC service or repair. The actual discount equals the service or repair charge, capped at $100. Promotional Period: All above promotions are valid for a limited time throughout 2025. Kalos reserves the right to modify or terminate any promotion early (for example, if a manufacturer sponsor changes funding, or if laws/rules require change), but any such change will be noted on our website or available via our office. If you have already booked a service with a promo code prior to a change, we will generally honor the promotion as it was at time of booking. Always check our latest promotional information or ask our representative if you have questions about current offers.
3. General Conditions and Limitations on Promotions
The following general terms apply to the promotion above, in addition to the specific details listed for each offer:
- Cannot be Combined: Promotional offers cannot be combined with any other coupons, discounts, or promotions. Only one promotion or discount can be applied to a single service or transaction. For example, you cannot apply both Resi2025 and another coupon to the same residential service or repair to increase the discount – only the single discount will be honored.
- No Cash Value & Non-Transferable: Promotions have no cash value and cannot be redeemed for cash or credit. If the value of the promotion exceeds the price of the service (e.g. a service or repair costs less than $100), no cash or refund is given – the service will simply be free or discounted up to $0 due. Unused promotional value is forfeited and cannot be applied to other services. Promotions are non-transferable; they are intended for the eligible customer and property and may not be sold or given to another party.
- Disclosure of Conditions: All conditions for each “free” or discounted offer are disclosed herein in a clear and conspicuous manner, in compliance with Florida’s advertising laws. There are no hidden obligations: you either pay for the primary service to get the free item, or meet the stated criteria to get the discount. If you have any questions about what is required to qualify for a promotion, please ask us – we strive for transparency in all offers.
- Limited Time & Availability: These promotions are offered for the 2025 calendar year. Some promotions may be limited to the first X customers or subject to product availability. We will inform you of any such issues at time of scheduling.
- Reservation of Eligibility: Kalos reserves the right to verify your eligibility for a promotion. This may include confirming your address (to ensure it is in our service area and not previously redeemed), and confirming that you meet any other stated requirements. We reserve the right to decline or cancel the application of a promo if you do not actually qualify or if misuse/fraud is suspected (e.g. someone attempting to use multiple addresses or false information to claim multiple free items).
- Not an Extended Service Contract: These promotions are one-time offers related to specific services. They do not constitute a service contract or extended maintenance agreement. For any ongoing service needs beyond the initial promotion, standard rates and terms will apply (unless covered by a separate maintenance plan or warranty).
4. Payment Terms and Additional Fees
All services performed – even when discounted or partially free under promotion – are subject to the following payment terms and potential additional costs:
- Up-Front Pricing: Kalos will provide up-front pricing or an estimate for the service before work begins. The promotional discount or free item value will be applied to that price. You are responsible for any remaining balance after the discount. Payment in full of the net amount (after applying the promotion) is due at the time of service completion, unless other payment arrangements (such as financing, if available) have been made in writing. We accept standard payment methods (major credit cards, check, etc.) as communicated by our office.
- Diagnostic/Trip Fees: For repair or maintenance calls, a diagnostic fee or trip charge may apply. However, if the promotion covers the entire service (such as making a service or repair free) and that service is actually performed, we will typically waive any separate trip charge. If our technician arrives and no work is performed or the customer declines service after diagnosis, a diagnostic fee may still be charged to cover the technician’s time. We will disclose any such fee in advance.
- Permit Fees: Many HVAC services require local building permits per Florida law and local code. Permit fees are not covered by the promotions and must be paid by the customer. Any quoted installation price will either exclude permit fees (with those fees added at cost) or explicitly state them. Kalos will obtain required permits on your behalf, and you agree to pay the actual permit fee and any related government charges or third-party inspection fees. We will provide permit documentation and receipts as needed.
- Taxes: Any applicable taxes (such as state or local sales tax on materials/equipment) will be added to the charges as required by law. Promotional discounts apply to the base service price before tax; you are responsible for taxes on the full amount of any taxable items. (Note: Service labor in Florida is generally not sales-taxed, but equipment or material charges can be. We comply with all tax requirements.)
- Unforeseen Repairs or Code Upgrades: Promotions apply to the specified scope of work only. If during the course of service our technicians discover that additional repairs or parts are needed (for safety, code compliance, or to complete the job correctly), those additional costs are not covered by the promotion. For example, if installing a new HVAC unit, you might need an upgrade to the venting to meet code; such extra work would be an additional charge. We will always discuss and get approval for any add-on work before performing it. You have the right to decline additional work, but understand that we might be unable to complete the primary service or warranty the work if required repairs/upgrades are refused.
- Exclusions: Promotions do not cover: hazardous material handling (e.g. asbestos pipe removal), extensive modifications to structures (e.g. carpentry to access pipes), or non-standard installations beyond a typical scope. Such items, if needed, will be quoted separately. All exclusions will be clarified beforehand as much as possible.
- Customer Responsibilities: You agree to provide safe access to the work areas, shut-off locations, and necessary utilities (water, electricity) during service. If the work cannot be performed due to site conditions (e.g. unsafe working environment, presence of vermin/mold that was not disclosed), we may have to reschedule or cancel – potentially with a trip charge if you hadn’t informed us of the issue. We expect an adult homeowner (or authorized agent) to be present during the service appointment to approve work and payment unless other arrangements are made.
5. No Guarantee of Future Performance
While we stand by the quality of our workmanship, Kalos makes no guarantee or promise that the services or new equipment provided under these promotions will yield any specific level of performance, efficiency, or future condition of your system. HVAC systems are subject to many factors beyond our control – including age, prior condition, environmental factors, and usage patterns – which can affect their ongoing performance. Accordingly:
- No Warranty of Performance: Except for any manufacturer’s warranty on new equipment (e.g. the HVAC unit factory warranty) or any express written warranty we provide on our labor, we do not warrant that your system will perform without error or continue to work for any set time after our service. For example, a service or repair may help maintain your unit, but we do not guarantee that it will prevent all future issues or that the HVAC unit will function like new. No promotion or statement should be interpreted as a guarantee of cost savings or problem-free operation.
- System Design & Pre-Existing Conditions: We are not liable for limitations in your original system design or pre-existing conditions that are uncorrected. If your home’s HVAC system has flaws, installing new components may not resolve those underlying issues. Kalos’s promotional installation of equipment addresses the equipment itself and standard connection to your system, but does not guarantee improvement to pre-existing system issues unless explicitly included in the scope. Any recommendations we make for additional improvements are optional and not part of the promotion unless you separately contract for them.
- No “Health” or “Usage” Guarantee: Microbial growth (e.g. mold, bacteria) or air quality issues related to your HVAC systems are beyond the scope of this promotion and services, and we do not assume liability for them. We make no claims that services will improve your indoor air quality. If you have concerns about air quality/humidity, you may need additional services or specialists. Kalos is not responsible for any microbial growth that is present or that may develop in the future in your home; similarly, we are not responsible for any adverse health effects purportedly arising from pre-existing environmental conditions. We recommend addressing mold or water damage issues with qualified remediation experts.
- Indirect or Consequential Damages: To the fullest extent allowed by law, Kalos will not be liable for any indirect, incidental, or consequential damages arising from the use of the new equipment or services provided. For example, we are not liable for water damage if a newly installed component later leaks unexpectedly (beyond any warranty remedy), nor for higher utility bills or other incidental costs. Our liability for any claim is generally limited to the amount you paid for the service in question. (Certain consumer rights may apply; we do not intend to contravene any non-waivable legal rights.)
Note: Nothing in these Terms is intended to waive or limit any mandatory consumer protections under Florida or federal law. These disclaimers are provided to clarify our obligations and ensure realistic expectations. You are entitled to manufacturers’ warranties on new products (which we will pass along) and any standard service warranty we provide (we typically guarantee our workmanship for a stated period – details available upon request). We simply emphasize that beyond those assurances, we are not promising any specific long-term outcome or performance result from these promotions.
6. Right to Cancel (Florida Home Solicitation Sales & FTC Cooling-Off Rule)
We want our customers to be comfortable with their purchase decisions. If your purchase of services under these promotions qualifies as a “home solicitation sale” or other covered transaction under Florida or federal law, you have a legal right to cancel the transaction within 3 business days for a full refund. This section explains those rights and how to exercise them:
- Florida Home Solicitation Sale: Under Florida law, if a contract for services is negotiated at your home (or any place that is not our normal business office) and you sign the agreement at your home, it may be considered a home solicitation sale. Florida Statutes §501.025 provides that you have until midnight of the third business day after the day you sign the agreement to cancel the sale. For example, if you agreed to a repipe service at your home on a Friday, you can cancel until midnight of the following Wednesday (assuming no holidays in between) by proper notice.
- Federal FTC Cooling-Off Rule: Similarly, the Federal Trade Commission’s Cooling-Off Rule (16 C.F.R. Part 429) grants consumers 3 business days to cancel certain sales of $25 or more that occur at the buyer’s home or outside the seller’s usual place of business. Our intent is to fully comply with this rule for any applicable transaction. We consider the FTC rule and Florida law to be largely consistent, and we will ensure you receive the maximum protection afforded by both.
- How to Cancel: If you decide to cancel a qualifying sale, you must send or deliver a written notice of cancellation to us by midnight of the third business day after the transaction. The notice can be sent via email, mail, or hand-delivery. If mailing, it is effective as of the postmark date (we recommend using registered mail or getting a proof of mailing). The notice only needs to state your intention not to be bound by the sale – you can simply say “I am canceling this contract” and include your name, address, and date. We will provide a cancellation form at the time of sale, or you may use any written format as long as it’s signed/clear.
- Consequences of Cancellation: If you cancel within the allowed period, you will receive a full refund of any money you paid on the contract within 10 business days of cancellation (or sooner as required by law). We will also remove any installed equipment if feasible, and return your home to a condition as if the work had not been done, at no charge. (For example, if we installed a new HVAC unit and you cancel, we would uninstall it and reinstall your old one if available, or retrieve our equipment.) You will not be liable for any services or restocking fee due to a proper cancellation. Note that if a service was fully completed and paid for at your unsolicited request within the 3-day period (e.g. an emergency repair you asked us to do immediately), the right to cancel may not apply; however, generally these promotions involve planned installations that would fall under the rule if done at home solicitation. We will honor all legal obligations in any case.
- Exclusions: The 3-day cancellation right does not apply to certain transactions, such as those conducted entirely by phone or mail without in-person contact, or emergency home repairs that you initiate without any prior in-person solicitation. It also might not apply if you visited our business location to negotiate the contract. We will clarify if an exception is believed to apply. In any event, Kalos wants satisfied customers – if you have second thoughts shortly after a purchase, please communicate with us. Even if the formal “cooling-off” law doesn’t apply, we may work with you on a resolution or goodwill refund, at our discretion. Your trust is important to us.
We include this notice of your right to cancel in compliance with Florida law and the FTC rule, which deem it an unfair/deceptive practice not to inform consumers of these rights in door-to-door sales. You will also see a cancellation notice on any contract or financing paperwork we provide, if applicable, in accordance with legal requirements. Retain copies of all documents for your records.
7. Reservation of Rights to Refuse Service
Kalos reserves the right to refuse service or cancel a scheduled promotion redemption under certain circumstances, consistent with applicable law:
- Safety or Legal Concerns: If our technicians arrive on site and find unsafe conditions (e.g. severe mold infestation, aggressive animals, unsafe structural conditions, or the presence of hazardous materials) that were not disclosed, we may refuse to perform the work until such issues are remedied. We also will refuse any request that involves violating building codes, manufacturer instructions, or any law/ordinance. For instance, if a customer insists on installing equipment in a manner that violates code or using unlicensed materials, we will decline.
- Out of Area or Ineligible: If it turns out your location is outside our service area or otherwise ineligible (see Section 1), we may cancel the appointment. We strive to verify eligibility at booking, but in rare cases errors happen (e.g. an online booking outside our range). In such case, we will notify you and not charge any fee for the cancellation.
- Promotion Misuse: We reserve the right to refuse a promotion if fraud or misuse is suspected. This includes but is not limited to: use of a fake or duplicated promo code, attempts to redeem after expiration, or claiming to be a new customer when you are not (if a promotion is new-customer-only). We will communicate our findings to you; if we are mistaken, we will honor the promo. Otherwise, we may offer to proceed with service without the discount, or decline the job.
- Behavior and Conduct: Our technicians and staff should be treated with courtesy and provided a safe environment to work. Kalos may refuse or discontinue service if a customer or occupant is threatening, abusive, or engaging in harassing behavior towards our personnel. We will not tolerate discrimination or unlawful conduct at the job site. Should such an event occur, the technician may leave the premises and our office will follow up. Depending on the situation, a refusal of service under these grounds might result in the customer being billed for any work already performed or any special order equipment obtained, but any advance payments for incomplete work would be refunded.
- Notice of Refusal: If we must refuse or cancel service for any reason, we will make reasonable efforts to inform you (and explain the reason) as soon as possible. If rescheduling or remediation is possible (e.g. you correct the issue that made it unsafe), we will try to work with you to complete the service under the promotion at a later date if feasible. If not, any monies paid for the portion of work not performed will be refunded.
8. Force Majeure
Kalos is not responsible for any failure or delay in performing services or honoring promotions due to circumstances beyond our reasonable control (“force majeure”). This includes, but is not limited to: natural disasters (hurricanes, floods, lightning strikes), fires, epidemics or pandemics, government orders or restrictions, war, terrorism, or civil unrest, labor strikes or shortages, severe weather (e.g. if a hurricane disrupts schedules), supplier disruptions or material shortages, or utility outages. If such an event occurs that affects our ability to serve you on the scheduled date or at the promised price:
- We will notify you as soon as possible of the delay or issue. The promotion may be honored at a later date when service can safely resume, or if performance becomes impossible, we may cancel the service without liability.
- If a force majeure event causes the cost of providing the service or item to substantially increase (for example, a sudden supply shortage doubles the cost of a HVAC unit), we reserve the right to modify the offer or cancel, after discussing the situation with you. We assure you that any such decisions will not be made lightly and will be grounded in the actual impact of the unforeseen event.
- The customer likewise is not obligated to proceed if a force majeure event delays the project significantly – you may choose to cancel for a full refund if timing or other conditions change drastically due to these events. Our goal will be to reach a fair arrangement with each affected customer.
This clause is intended to protect both parties from events neither of us can control. We value your understanding in such rare situations.
9. Privacy Policy
Protecting your privacy is important to Kalos. Any personal information you provide to us during scheduling or service (such as name, contact info, addresses, or payment details) will be used in accordance with our Privacy Policy. Our full Privacy Policy is available on our website and describes how we collect, use, and safeguard your information. In summary, we only collect information necessary to perform services and improve our offerings, we do not sell your personal data, and we implement standard security measures to protect your data. By engaging our services or using our website, you consent to the terms of our Privacy Policy. If you have questions about how your data is handled, please contact us (see Section 10 below) before providing information. We may send you service reminders or promotional offers (including future promotions) via contact information you provide, but you can opt out of marketing communications at any time. 11. Governing Law and Venue
This Terms & Conditions agreement and any disputes arising from these promotions or services shall be governed by the laws of the State of Florida. We operate under Florida state contractor laws and consumer protection statutes, and we intend these terms to be consistent with all applicable Florida regulations. In the event of any conflict between these written terms and mandatory provisions of Florida or federal law, the law will prevail and we will be deemed to have amended the terms to conform to the law’s requirements.
Any legal action or proceeding concerning a dispute arising out of or relating to these promotions or services shall be brought in the courts of the State of Florida, situated in a competent jurisdiction for the location of the serviced property or our principal office. By agreeing to these terms, you consent to the jurisdiction of Florida courts. (Note: We truly hope to never see a dispute escalate to legal action. We pledge to attempt resolution through communication or mediation if possible.)
These Terms & Conditions do not override any rights you have under the Florida Deceptive and Unfair Trade Practices Act, the Florida Construction Lien Law, or other consumer laws, to the extent those apply. We consider our compliance with advertising and contracting standards a serious matter of trust.
By using any of the above promotions or engaging our services under a promotional offer, you acknowledge that you have read and agree to these Terms & Conditions. If you do not agree, you should not proceed with redeeming the promotion; instead, you may choose to hire our services at standard rates or discuss alternatives.
